1. Introduction

Welcome to Bright Start ("Bright Start," "we," "our," or "us"). Bright Start is a mobile application designed to promote healthier digital habits by encouraging reduced screen time in the morning and promoting exposure to natural light. These Terms of Use ("Terms") form a legally binding agreement between you (the "User," "you," or "your") and Bright Start.

By downloading, installing, accessing, or using the Bright Start mobile application, website, features, content, or related services (collectively, the "Service"), you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, do not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age (or the minimum required age in your jurisdiction);
  • You are legally capable of entering into a binding contract;
  • You are not barred from using the Service under any applicable law.

Use of the Service is void where prohibited.

3. Account Registration and Security

To access certain features of the Service, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process;
  • Maintain the security of your password and credentials;
  • Not share your account or permit others to use it;
  • Promptly notify us of any unauthorized use or breach of security.

You are solely responsible for all activity under your account, regardless of whether you authorized it. We reserve the right to terminate accounts that violate our policies, are inactive, or pose a security risk.

4. Description of Services

Bright Start offers digital wellness tools, including but not limited to:

  • Scheduled or rule-based app restriction
  • Morning screen time locks
  • Sunlight exposure detection (via Google Vision API or other means)
  • Screen time analytics (via Apple Screen Time API)
  • AI-based recommendations
  • Mood tracking
  • Usage logging and trend visualization
  • Behavior nudges, reminders, and habit formation insights
  • Integration with weather data sources (weatherapi.com)
  • Push notifications and motivational prompts

We may update, remove, or enhance features at any time without notice. Certain features may not be available on all devices, in all regions, or across all operating systems.

5. Subscriptions, In-App Purchases, and Billing

Bright Start offers both free and premium tiers.

Billing and Payment:

  • All purchases are processed via the Apple App Store.
  • We do not store or process your payment information.
  • Subscription charges may apply on a recurring basis unless you cancel.
  • All billing issues and refunds are managed exclusively through Apple.

Trial Offers:

We may offer time-limited trials. Abuse of trial systems (e.g., creating multiple accounts) is prohibited and may result in immediate termination of service.

Changes to Pricing:

We reserve the right to modify pricing or subscription features at any time. You will be notified of material changes where required by law.

6. Acceptable Use Policy

You agree not to use the Service:

  • In any way that violates local, state, national, or international law;
  • To exploit, harm, or attempt to exploit or harm minors;
  • To send spam, malware, or any other malicious software;
  • To attempt to gain unauthorized access to any part of the Service or related systems;
  • To impersonate any person or misrepresent your affiliation;
  • To develop competing applications or reverse-engineer the app.

7. Intellectual Property

All content on the Service—including but not limited to text, code, design elements, logos, graphics, software, audio, and video—is the intellectual property of Gaurav Thapa or our licensors and is protected by intellectual property laws worldwide.

You may not:

  • Copy, reproduce, redistribute, modify, or reverse engineer any portion of the Service;
  • Use our branding without explicit written permission;
  • Claim ownership or authorship over our content or software.

8. Third-Party Services and Integrations

Bright Start integrates with third-party platforms, including but not limited to:

  • Apple APIs: Screen Time, HealthKit
  • Google Vision API: For image-based light detection
  • weatherapi.com: For location-based environmental data
  • Other analytics, bug tracking, or crash reporting services

We are not responsible for the content, functionality, or privacy practices of any third-party services. Use of these services is subject to their respective terms and policies.

9. Health and Wellness Disclaimer

Bright Start is not a medical app and is not intended to diagnose, treat, cure, or prevent any condition. The information provided through Bright Start is for general wellness purposes only and should not be considered medical advice. Always consult with a licensed professional before making health-related decisions.

We do not guarantee:

  • That morning sunlight exposure will improve your health;
  • That blocking apps will resolve issues like anxiety, sleep problems, or attention deficits;
  • That behavioral nudges will lead to sustained habit changes.

Any reliance on information from Bright Start is at your own risk.

10. No Guarantee of Results

We do not guarantee:

  • That your app usage will reduce;
  • That your mood or focus will improve;
  • That you will wake up earlier or form habits as suggested.

We make no representation as to the effectiveness or accuracy of data derived from our APIs or AI-based suggestions. These are experimental, heuristic, and non-scientific in nature.

11. Service Availability

We strive for continuous availability of the Service but cannot guarantee:

  • That the app will be uninterrupted, error-free, or secure;
  • That bugs or inaccuracies will be promptly corrected;
  • That the app will function in all environments, screen sizes, or device types.

We are not liable for outages, data loss, or degraded experiences due to internet failures, OS updates, or changes to third-party platforms.

12. Termination of Access

We reserve the right to:

  • Suspend or terminate access to the Service at our sole discretion, for any reason;
  • Deactivate your account in case of inactivity, suspected fraud, or violations of these Terms;
  • Remove content or data we believe violates these Terms or the law.

Termination may be temporary or permanent and may occur without prior notice.

13. Indemnification

You agree to indemnify, defend, and hold harmless Gaurav Thapa, Bright Start, and its affiliates, employees, contractors, partners, licensors, and suppliers from any and all claims, liabilities, damages, losses, and expenses (including legal fees and costs) arising from or related to:

  • Your use or misuse of the Service;
  • Your violation of these Terms or applicable law;
  • Any content you upload or distribute through the Service;
  • Any third-party claim that your use of the Service violates their rights.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Bright Start is provided "as is" and "as available."
  • We disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
  • We are not liable for any indirect, incidental, punitive, or consequential damages—including loss of data, loss of profits, emotional distress, health deterioration, or system failures—even if we have been advised of the possibility.
  • Our total liability to you for all claims arising out of or related to the Service shall not exceed AUD $50.00.

This limitation applies even if the remedies fail of their essential purpose.

15. Force Majeure

We are not responsible for any failure to perform due to causes beyond our control, including but not limited to:

  • Natural disasters
  • Internet outages
  • Government actions
  • Civil disturbances
  • Supply chain failures
  • Third-party service disruptions
  • Pandemics or health emergencies

16. Changes to the Service or Terms

We reserve the right to:

  • Modify or discontinue the Service (in whole or in part) at any time;
  • Update these Terms at our discretion without prior notice, unless required by law.

If we make material changes, we will notify you via in-app alerts, email, or website notices. Continued use after changes constitutes acceptance of the revised Terms.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts in New South Wales for any legal dispute.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder will continue in full force. No waiver of any term shall be deemed a further or continuing waiver.

19. Entire Agreement

These Terms (along with our Privacy Policy and any supplemental policies) constitute the entire agreement between you and Bright Start regarding your use of the Service, superseding any prior agreements, communications, or understandings.
